A. Background
- On July 3, 2001, OSHA delayed the effective date of two of the provisions of the recordkeeping regulation from January 1, 2002 until January 1, 2003. One of the provisions (1904.10) related to recording of hearing loss and the other provision (1904.12) concerned musculoskeletal disorder (MSD). OSHA on July 1, 2002, issued a final rule, effective January 1, 2003, amending section 1904.10 on hearing loss requiring the recording of Standard Threshold Shifts (defined as 10 dB shifts in hearing acuity) that have resulted in a total 25 dB level of hearing above audiometric zero, averaged over the frequencies at 2,000, 3,000, and 4,000 Hertz (Hz). On January 1, 2002, OSHA also issued a notice to delay the effective date of 1904.12 until January 1, 2004.
- On January 29, 2003, the Commissioner of Labor and Industry adopted amendments to Regulation .02 under COMAR 09.12.21 Employee Injury and Illness Records and Reports relating to 1904.10. This action includes the adoption through incorporation by reference, revisions under 29 CFR 1904 and 1952 on Occupational Injury and Illness Recording and Reporting Requirements.
