A. Background
- On December 31, 2003, OSHA issued a final rule revoking "Respiratory Protection for M. Tuberculosis" (29 CFR 1910.139). OSHA will apply the general industry standard for respiratory protection (29 CFR 1910.134) to respiratory protection against tuberculosis.
- On June 15, 2004, the Commissioner of Labor and Industry adopted through incorporation by reference under COMAR 09.12.31 Maryland Occupational Safety and Health Act – Incorporation by Reference of Federal Standards, the revocation of Respiratory Protection for M. Tuberbulosis (29 CFR 1910.139).
B. Action
- MOSH Compliance personnel will enforce the adopted changes as provided in Attachment A.
- MOSH Supervisors will hold appropriate training sessions in each region to review the standard’s requirements.
