($100.00) for not having the colors for “The Revanger”, entered to run in the sixth race at Laurel Park on March 27, 2022, after receiving a fine on (02/13/2022) for the same offense.

THIS IS A VIOLATION OF: [COMAR 09.10.01.09] which states in part……
“It shall be the sole responsibility of the trainer to see that his or her owner’s colors are in the jockey’s quarters to be used for his or her respective entries, failure to do so, the trainer will be subject to fine”.

#22-069 In the matter of the fifth race at Laurel Park on April 9, 2022, regarding the OFFICIAL result.

On April 9, 2022, trainer Benjamin Perkin, Jr. filed an appeal with the Maryland Racing Commission. The appeal contests the Stewards' decision to disqualify the horse “Blueberry Indygo” from first position.

As a result of that appeal, the fifth race on April 9, 2022, is hereby declared in dispute and the following ordered to remain in effect until the dispute has been settled by the Maryland Racing Commission:

(1) Both “She Is Wisky” and “Blueberry Indygo” shall be subject to all penalties attached to the winner of the race [COMAR 09.10.04.15, A (1)]; and
(2) The purse monies affected by the dispute are to be held by the Horsemen's Bookkeeper.

Inside the 1/8th pole, #2 “ Party Monster”, down on the inside, is hit one time left-handed and comes out a number of paths before being corrected, interfering with #3 “Miss Seductive” ridden by apprentice jockey Jeiron Barbosa on the outside, forcing that rider to take up and alter course to avoid possibly clipping heels.

#22-074 In the matter of the horse “Other Things Equal” owned by Original 6 Stable trained by Michael E. Gorham in the first race on April 1, 2022 at Laurel Park.
On April 8, 2022 the Stewards were notified by a Racing Commission Veterinarian that the horse “Other Things Equal” that ran on April 1, 2022 was ineligible to participate. An investigation was conducted. A hearing was held on April 15, 2022 including Mr. Gorham. Also present was Dr. Libby Daniel, Equine Medical Director.

Based upon the evidence of the investigation and testimony presented at the hearing, the Stewards found the following:
(1) The horse “Other Things Equal”, trained by Michael E. Gorham, was entered by him to run in the first race at Laurel Park on April 1, 2022.
(2) “Other Things Equal” ran within 14 days of an Intra-Articular Injection.

Based upon the above, and in accordance with COMAR 09.10.03.04(F), the Stewards hereby find that “Other Things Equal” was ineligible to race at the time it ran in the first race on April 1, 2022. All money earned by “Other Things Equal” to be returned.

Accordingly, “Other Things Equal” is hereby disqualified from the first race at Laurel Park on April 1, 2022.

#22-076 In the seventh race at Laurel Park on April 15, 2022, horse #1 “Foggy Dreams”, ridden by apprentice jockey Jeiron Barbosa, was disqualified
from third position and placed fifth. Going into the far turn, #1 ”Foggy Dreams” is on the lead and comes over into the path of #3 “Dulce Kiara” ridden by jockey Xavier Perez, causing that horse to clip heels and the rider to take up.

#22-077 On February 16, 2022, the Stewards received notice from Industrial Laboratories that blood sample #E451452 dated January 28, 2022, contained the drug phenylbutazone
at 408+-65ng/ml or .408 mg/ml which is in excess of the accepted threshold of .3 mg/ml phenylbutazone established by the MRC. See COMAR 09.10.03.01. The Stewards, having established that blood sample #E451452 was taken from the horse “Fancy Princess”, owned by Debbie Abshire and trained by Bobby Plummer, following the running of the second race at Laurel Park on January 28, 2022. The Stewards notified Mr. Plummer that:
(1) the presence of phenylbutazone, at this level, in the system of “Fancy Princess” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) he had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) he had the right to be represented by counsel at the hearing.

Mr. Plummer did exercise his right to the split sample testing. (COMAR 09.10.03.09 H 1, 2,& 3) Upon receiving confirmation from Analytical Toxicology Lab that phenylbutazone is present in sample #E451452 dated January 28, 2022, at a quantity level of 330 +/- 18 ng/ml. the Stewards contacted Mr. Plummer of the results of the split sample.

The Stewards held a hearing via telephone on April 16, 2022, wherein Mr. Plummer waived his right to legal counsel.

Based upon the evidence before them, the Stewards find the following:
(1) “Fancy Princess” did carry an overage of phenylbutazone, in its system when it finished third in the second race at Laurel Park on January 28, 2022, a violation under COMAR 09.10.03.04,C ;
(2) Bobby Plummer, as trainer, was the absolute insurer of, and responsible for, the condition of “Fancy Princess” at the time the horse ran (Sections D & F);
(3) A horse found to have carried a drug in its body during a race may be disqualified and the purse monies earned by that horse redistributed.

Based upon the foregoing and taking into account mitigating circumstances, the Stewards hereby order that:

Trainer Bobby Plummer be fined Five hundred ($500.00) dollars.

The horse, “Fancy Princess” be disqualified from the second race from January 28, 2022.

#22-078 In the matter of the ninth race at Laurel Park on February 21, 2022;

On April 5, 2022, the Maryland Racing Commission convened to hear the appeal of owner Robert D. Bone. The Commission voted to uphold the Stewards decision in this matter and declared Gene Gould, Jr’s. “El Bochinche” the winner.

The owner of “Birthday Wish”, Robert D. Bone has accepted the decision and will not exercise his right to appeal. Therefore the new official order of finish is as follows;

#22-080 On April 13, 2022, the Stewards received notice from Industrial Laboratories that blood sample #E451958, dated March 20, 2022, contained the drug naproxen
. The Stewards established that blood sample #E451958 was taken from the horse “Heymackit’sjack”, owned by Mariano Brothers Stable and trained by Keri Brion, following the running of the seventh race at Laurel Park on March 20, 2022. The Stewards notified Ms. Brion that: (1) the presence of naproxen in the system of “Heymackit’sjack” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2)she had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3)she had the right to be represented by counsel at the hearing.

The Stewards held a hearing on April 21, 2022, via telephone wherein Ms. Brion waived her right to a split sample and legal counsel.

Based upon the evidence before them, the Stewards find the following:

(1)“Heymackit’sjack” did have naproxen, in its system when it finished sixth in the seventh race at Laurel Park on March 20, 2022, a violation under COMAR 09.10.03.04,C;
(2) Keri Brion, as trainer, was the absolute insurer of, and responsible for, the condition of “Heymackit’sjack” at the time the horse ran (Sections D & F);
(3) A horse found to have carried a drug in its body during a race may be disqualified and the purse monies earned by that horse redistributed and
(4) An individual found to have violated these Regulations may be subject to a fine issued by the Stewards of up to $2,500 and a suspension of any license issued by the Maryland Racing Commission of up to 360 days. COMAR 09.10.03.02, Section A.

Based upon the foregoing, the Stewards hereby order:

(1) Trainer Keri Brion is fined Five Hundred ($500.00) dollars
(2) The horse “Heymackit’sjack” be disqualified from the seventh race on March 20, 2022.
(3) The Horsemen’s Bookkeeper redistribute all purse monies for that race in accordance with the following order:

#22-081 On April 13, 2022, the Stewards received notice from Industrial Laboratories that blood sample #E451946, dated March 20, 2022, contained the drug dexamethasone.
The Stewards established that blood sample #E451946 was taken from the horse “Daper’s Drink”, owned and and trained by Mario Serey, Jr., following the running of the first race at Laurel Park on March 20, 2022. The Stewards notified Mr. Serey that: (1) the presence of dexamethasone in the system of “Daper’s Drink” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) he had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) he had the right to be represented by counsel at the hearing.

The Stewards held a hearing on April 23, 2022, wherein Mr. Serey waived his right to a split sample and legal counsel.

Based upon the evidence before them, the Stewards find the following:

(1)“Daper’s Drink” did have dexamethasone, in its system when it finished eighth in the first race at Laurel Park on March 20, 2022, a violation under COMAR 09.10.03.04,C;
(2) Mario Serey, Jr., as trainer, was the absolute insurer of, and responsible for, the condition of “Daper’s Drink” at the time the horse ran (Sections D & F);
(3) A horse found to have carried a drug in its body during a race may be disqualified and the purse monies earned by that horse redistributed and
(4) An individual found to have violated these Regulations may be subject to a fine issued by the Stewards of up to $2,500 and a suspension of any license issued by the Maryland Racing Commission of up to 360 days. COMAR 09.10.03.02, Section A.

Based upon the foregoing, the Stewards hereby order:

(1) Trainer Mario Serey, Jr. be fined One thousand-five hundred dollars ($1,500.00)
(2) Trainer Serey be suspended Fifteen (15) days. The suspension is stayed under the stipulation that he not have another class 3 violation within 365 day period.
(3) The horse “Daper’s Drink” be disqualified from the first race on March 20, 2022.
(4) The Horsemen’s Bookkeeper redistribute all purse monies for that race in accordance with the following order:

#22-083 On April 20, 2022, the Stewards received notice from the Industrial Laboratories that urine sample #E452038, dated April 1, 2022, contained the drug 2-(1-hydroxyethyl)promazine sulfoxide
at a level of 23.6+- 1.7 nanograms/ml which is above the threshold of 10 nanograms set forth for this drug. The Stewards established that urine sample #E452038 was taken from the horse “Justinthenickoftime”, owned by Liberty House Racing and trained by Justin Rivera, following the running of the fourth race at Laurel Park on April 1, 2022. The Stewards notified Mr. Rivera that: (1) the presence of 2-(1-hydroxyethyl)promazine sulfoxide at this level, in the system of “Justinthenickoftime” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) He had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) He had the right to be represented by counsel at the hearing.

The Stewards held a hearing on April 24, 2022, via telephone, wherein Mr. Rivera waived his right to a split sample and legal counsel.

Based upon the evidence before them, the Stewards find the following:

(1) “Justinthenickoftime” did carry an overage of 2-(1-hydroxyethyl) promazine sulfoxide in its system when it finished second in the fourth race at Laurel Park on April 1, 2022, a violation under COMAR 09.10.03.04, Section C;
(2) Justin Rivera, as trainer, was the absolute insurer of, and responsible for, the condition of “Justinthenickoftime” at the time the horse ran (Sections D, E & F);
(3) A horse found to have carried a drug in its body during a race may be disqualified and the purse monies earned by that horse redistributed and
(4) An individual found to have violated these Regulations may be subject to a fine issued by the Stewards of up to $2,500 and a suspension of any license issued by the Maryland Racing Commission of up to 360 days. COMAR 09.10.03.02, Section A.

Based upon the evidence presented at the hearing, the Stewards hereby order that:

(1) Trainer Justin Rivera, be fined in the amount of Five Hundred dollars ($500.).
(2) Trainer Rivera be suspended Fifteen (15) days. The suspension is stayed under the stipulation that he not have another class 3 violation within 365 day period
(3) The horse “Justinthenickoftime”, be disqualified from the fourth race on April 1, 2022 at Laurel Park.
(4) The Horsemen’s Bookkeeper redistribute all purse monies for that race in accordance

#22-084 On March 12, 2022, the Stewards received notice from Industrial Laboratories that blood sample #E451635 dated February 18, 2022, contained the drug phenylbutazone
at 13.86+-.07 mg/ml which is in excess of the accepted threshold of .3 mg/ml phenylbutazone established by the MRC. See COMAR 09.10.03.01. The Stewards, having established that blood sample #E451635 was taken from the horse “California Bella”, owned by No Guts No Glory Farm and Marisa Gino and trained by John J. Robb, following the running of the sixth race at Laurel Park on February 18, 2022. The Stewards notified Mr.Robb that: (1) the presence of phenylbutazone, at this level, in the system of “California Bella” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) he had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) he had the right to be represented by counsel at the hearing.

Mr. Robb did exercise his right to the split sample testing. (COMAR 09.10.03.09 H 1, 2,& 3) Upon receiving confirmation from Analytical Toxicology Lab that phenylbutazone is present in sample #E451635 dated February 18, 2022, at a quantity level of 15.3+-1.5mg/ml. the Stewards contacted Mr. Robb of the results of the split sample.

The Stewards held a hearing via telephone on April 27, 2022, wherein Mr. Robb waived his right to legal counsel.

Based upon the evidence before them, the Stewards find the following:
(1) “California Bella” did carry an overage of phenylbutazone, in its system when it finished first in the sixth race at Laurel Park on February 18, 2022, a violation under COMAR 09.10.03.04,C;
(2) John J. Robb, as trainer, was the absolute insurer of, and responsible for, the condition of “California Bella” at the time the horse ran (Sections D & F);
(3) A horse found to have carried a drug in its body during a race may be disqualified and the purse monies earned by that horse redistributed.

Based upon the foregoing, the Stewards hereby order that:

(1) Trainer John J. Robb be fined Five hundred ($500.00) dollars.
(2) The horse, “Californis Bella” be disqualified from the sixth race from February 18, 2022.

#22-086 On March 30, 2022, the Stewards received notice from the Industrial Laboratories that blood sample #E451392, dated March 20, 2022, contained the drug methocarbamol
at a level of 2.36+- 0.19 ng/ml which is above the threshold of 1 nanograms set forth for this drug. The Stewards established that blood sample #E451954 was taken from the horse “Offlee Graysful”, owned and trained by Melvin Ovando, following the running of the fifth race at Laurel Park on March 20, 2022. The Stewards notified Mr. Ovando that: (1) the presence of methocarbamol at this level, in the system of “Offlee Graysful” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) He had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) He had the right to be represented by counsel at the hearing.

The Stewards held a hearing on April 27, 2022,via telephone wherein Mr. Ovando waived his right to legal counsel and a split sample.
Based upon the evidence before them, the Stewards find the following:

(1) “Offlee Graysful” did carry an overage of methocarbamol in its system when it finished sixth in the fifth
race at Laurel Park on March 20, 2022, a violation under COMAR 09.10.03.04, Section C;
(2) Melvin Ovando, as trainer, was the absolute insurer of, and responsible for, the condition of “Offlee Graysful” at the time the horse ran (Sections D, E & F);
(3) A horse found to have carried a drug in its body during a race may be disqualified and the purse monies earned by that horse redistributed and

Based upon the evidence presented at the hearing and taking into account mitigating circumstances, the Stewards hereby order that:

(1) Trainer, Melvin Ovando be fined in the amount of Five hundred ($500.) dollars.
(2) The horse “Offlee Graysful”, be disqualified from the first race on January 22, 2022 at Laurel Park.
(3) The Horsemen’s Bookkeeper redistribute all purse monies for that race in accordance with the following order:

April 29, 2022 - Laurel Park
#22-087 On December 15, 2021, the Stewards received notice from Industrial Laboratories that blood sample #32613 dated November 26, 2021, contained the drug 5-hydroxydantrolene
at 314+-20 pg/ml which is in excess of the accepted threshold of 100 pg/ml established by the MRC. See COMAR 09.10.03.01. The Stewards, having established that blood sample #32613 was taken from the horse “Stay Out”, owned by Lynwood Napier and trained by Dale Capuano, following the running of the third race at Laurel Park on November 26, 2021. The Stewards notified Mr.Capuano that: (1) the presence of 5-hydroxydantroloene, at this level, in the system of “Stay Out” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) he had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) he had the right to be represented by counsel at the hearing.

Mr. Capuano did exercise his right to the split sample testing. (COMAR 09.10.03.09 H 1, 2,& 3) Upon receiving confirmation from Analytical Toxicology Lab that 5-hydroxydantrolene is present in sample #32613 dated November 26, 2021, at a quantity level of 306+-42 pg/ml-. The MRC Investigators contacted Mr. Capuano of the results of the split sample.

The Stewards held a hearing on April 29, 2022, wherein Mr. Capuano waived his right to legal counsel.

Based upon the evidence before them, the Stewards find the following:
(1) “Stay Out” did carry an overage of 5-hydroxydantrolene, in its system when it finished first in the third race at Laurel Park on November 26, 2021, a violation under COMAR 09.10.03.04,C;
(2) Dale Capuano, as trainer, was the absolute insurer of, and responsible for, the condition of “Stay Out” at the time the horse ran (Sections D & F);
(3) A horse found to have carried a drug in its body during a race may be disqualified and the purse monies earned by that horse redistributed.

Based upon the foregoing, the Stewards hereby order that:

(1) Trainer Dale Capuano be fined Five hundred ($500.00) dollars.
(2) The horse, “Stay Out” be disqualified from the third race from November 26, 2021.
(3) The Horsemen’s Bookkeeper redistribute all monies for that race in accordance with the following order;

from fourth position and placed fifth. Soon after leaving the gate #1a, racing greenly, shies away from the horse outside of him and ducks into and bumps #4 “She’srunninghappy” ridden by jockey Joseph Trejos knocking that horse off stride.
