Inside the 1/8th pole, #6 “Magnolia Wind” starts drifting out and continues coming out herding #7 “In Her Cups” ridden by Jean Briceno, well out in the stretch. Mr. Ho never made an effort to steer his horse back into a straight line. The horses continued on to the wire in a close finish.

#23-135 In the matter of the third race at Laurel Park on November 9, 2023, regarding the Official result.

On November 11, 2023 owner Albert P. Abdala III filed an appeal with The Maryland Racing Commission. The appeal contests the Stewards’ decision to disqualify the horse “Magnolia Wind” from first position.

As a result of that appeal, the third race from November 9, 2023 is hereby declared in dispute and the following ordered to remain in effect until the dispute has been settled by the Maryland Racing Commission.

Both “In Her Cups” and “Magnolia Wind” shall be subject to all penalties attached to the winner of the race. [COMAR 09.10.04.15 A (1)] and
The purse monies affected by the dispute are to be held by the Horsemen’s Bookkeeper.
