Jockey, Xavier Perez is in violation of the HISA riding crop rule #2280 (b)(1). During the running of the ninth race on September 28, 2024, jockey Perez hit his mount “Studlydoright” 9 times which are in violation of the 6-strike rule. On September 29, 2024, Mr. Perez waived his right to a hearing. This is the second offence for Mr. Perez in a 180-day span.
The Stewards issued the following penalty.

  1. (1) Mr. Perez is fined One thousand ($1,000.00) dollars.
  2. (2) Mr. Perez is suspended two (2) racing days, October 13 and 17, 2024.
  3. (3) Mr. Perez has thirty (30) days to pay his fine with HISA.

Shortly after the start, #8 “Preparefortakeoff” is angled in by jockey Briceno, he comes inward quickly but is not clear forcing the rider of #4 “Union Suit” Jorge Ruiz to turn his horse in and then take back sharply to avoid clipping heels. The #4 “Union Suit” continues on and gets beat in a tight finish.

Around the ¼ pole, #1 “Dirty Gold” was on the inside and behind a horse. The rider angled his horse out to the right, without sufficient clearance, into the path of #2 “Closertotheheart” ridden by jockey Jeiron Barbosa, forcing him to take up sharply to avoid clipping heel and costing him a chance at a better finishing position.

In the matter of Stable employee Cesar Magdaleno: On October 11, 2024 Mr. Magdaleno was requested to deliver urine sample by the MRC Investigators. The specimen he rendered tested positive for Marijuana, Cocaine and opioids.

COMAR 09.10.03.05 A(1)(a)(i).

A hearing was held on October 13, 2024. Mr. Magdaleno appeared in the absence of counsel and waived his right thereto. Based upon the testimony and evidence presented at the hearing, the Stewards found Cesar Magdaleno in violation of COMAR 09.10.03.05 Drug Prohibition-Humans.

Accordingly, the Stewards hereby order:
(1) That the license issued to Cesar Magdaleno be suspended until such time as he has been professionally evaluated and deemed not a detriment to racing. [COMAR 09.10.03.05, F(1)].
(2) That while he is under suspension, Mr. Magdaleno will not be allowed to work on the backside.

In the matter of Exercise Rider Miguel Beltran: On October 11, 2024 Mr. Beltran was requested to deliver urine sample by the MRC Investigators’. Beltran agreed to produce a urine sample and signed the appropriate paperwork stating such. Mr. Beltran could not provide a sample so he was instructed to return the next day to provide a sample. Mr. Beltran failed to show up to deliver a sample, therefore the Stewards considered that a refusal and deemed it a failed test.

COMAR 09.10.03.05 A(1)(a)(i).

A hearing was held on October 13, 2024. Mr. Beltran appeared in the absence of counsel and waived his right thereto. Based upon the testimony and evidence presented at the hearing, the Stewards found Miguel Beltran in violation of COMAR 09.10.03.05 Drug Prohibition-Humans.

Accordingly, the Stewards hereby order:
(1) That the license issued to Miguel Beltran be suspended until such time as he has been professionally evaluated and deemed not a detriment to racing. [COMAR 09.10.03.05, F(1)].
(2) That while he is under suspension, Mr. Beltran will not be allowed to work on the backside.

Coming out of the gate #9 breaks in very hard to the left and bumps #8 “Remembering Lizzy” ridden by Jevian Toledo and #7 “Tres Aries” ridden by Angel Cruz. The #7 gets its hind end turned sideways and the rider loses his stirrup.
